These terms govern your use of Yoyo Yorùbá (the “App”), a multilingual children’s language-learning app published by The Ifa Company®. By downloading, accessing or using the App you agree to these terms. If you do not agree to them, please do not use the App.
01Who may use the App
- The App is made for children and is intended to be installed and supervised by a parent, guardian or teacher.
- By installing the App or allowing a child to use it, you confirm that you are an adult with the legal capacity to accept these terms, and that you accept them on behalf of any child who uses the App on your device.
- You are responsible for supervising your child’s use of the App and of the device it runs on.
02No accounts
The App has no sign-up or login. Lesson progress and settings are stored only on the device. This means progress is not backed up by us and cannot be recovered or transferred by us if the App is deleted, the device is reset, or the device is lost. 03Licence
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App and its lessons for private, non-commercial family or classroom use. You may not copy, record, redistribute, resell, sublicense, publicly perform, modify, decompile or create derivative works from the App or any of its lessons, illustrations or audio, except where the law expressly permits it.
04Subscriptions and payments
- Part of the App is free. A subscription unlocks premium lessons and features.
- Subscriptions are sold through Apple in-app purchase and Google Play billing and are charged to the store account used to make the purchase. Their terms and their privacy policies apply to the transaction.
- A subscription renews automatically at the end of each billing period unless it is cancelled at least 24 hours before that period ends. Cancellation is done in your Apple or Google account settings, not in the App.
- Payments are non-refundable except where required by law or under Apple’s or Google’s own refund policies. Refund requests must be made to the store that processed the payment.
- Because the App has no accounts, a subscription belongs to the store account that bought it and is restored on a new device using that store account’s restore-purchases function.
- We may change subscription pricing or the contents of a plan. Changes take effect at the next renewal and never retroactively for a period already paid for.
05Content and intellectual property
- The App and its content — lessons, text, illustrations, audio recordings, music, software, name and logo — are owned by The Ifa Company® or licensed to it, and are protected by intellectual property law.
- Where content is provided by third-party contributors, narrators or illustrators, it remains the property of its owner and is used under licence.
- Yorùbá and other language content is presented for educational purposes. We take care over pronunciation, tone marking and translation, but we do not warrant that every item is free of error or matches every regional variety.
06Acceptable use
You agree not to:
- Use the App for any unlawful purpose or in breach of any applicable law or third-party right.
- Extract, scrape, mirror or republish lesson content, audio or artwork.
- Attempt to gain unauthorised access to the App, its servers or its networks, or to circumvent any purchase, security or access control.
- Interfere with or disrupt the operation of the App or its services.
07Availability and changes to the App
We may add, change, suspend or withdraw features, lessons or the App itself at any time, and we may stop supporting older operating system versions. We aim to give reasonable notice where a change materially reduces what a paid subscription provides.
08Termination
These terms apply for as long as you use the App. You may end them at any time by deleting the App. We may suspend or withdraw access if you breach these terms. Ending the licence does not automatically refund a subscription period already paid for; cancellation and refunds are handled by Apple or Google.
09Disclaimer of warranties
The App is provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be error free, secure or uninterrupted, or that it will produce any particular learning outcome.
10Limitation of liability
To the fullest extent permitted by law, The Ifa Company® and its affiliates, officers, employees and licensors are not liable for any indirect, incidental, special, consequential or punitive damages, including loss of data or loss of saved progress, arising out of or related to your use of the App. Nothing in these terms limits liability that cannot be limited by law.
11Indemnity
You agree to indemnify and hold harmless The Ifa Company® and its affiliates, officers, employees and licensors from any claims, liabilities, damages, losses or expenses, including reasonable legal fees, arising out of your use of the App or your breach of these terms.
12Third-party services
Distribution, billing and crash reporting are provided by Apple and Google. Those services are not controlled by us and we are not responsible for their content, policies or practices. Apple and Google are not parties to these terms and have no responsibility for the App, but they may enforce these terms as third-party beneficiaries where their platform rules require it.
13Changes to these terms
We may update these terms from time to time. The version published on this page is the one in force, and the date at the top of the page shows when it last changed. Continued use of the App after a change takes effect is acceptance of the revised terms.
14Governing law
These terms are governed by the laws of the State of Texas, USA, without regard to its conflict of law rules. Disputes arising under them are to be resolved in the courts of Texas, USA, except where mandatory consumer law in your country of residence gives you the right to bring proceedings elsewhere.
